Minimum freight value. What is the importance of establishing values?

Observing the minimum freight value is very important both for truckers and for those who contract their services. After all, in addition to guaranteeing good working conditions for professionals in that sector, the law establishes heavy fines for those who violate these rules.

The minimum freight value was created by the “Política Nacional de Pisos Mínimos do Transporte Rodoviário de Cargas”, after the truckers’ strike of 2018. Law 13.703 specifies that the minimum freight floors must reflect the total transport operating costs.

Established by the Law 13.703, of August 8, 2018, the “Política Nacional de Pisos Mínimos do Transporte Rodoviário de Cargas” is popularly known as the freight table. It formalizes the establishment of a table with minimum prices for cargo transportation. The table publication, the values definition and the inspection are the responsibility of the “Agência Nacional de Transportes Terrestres” (ANTT).

According to the legislation, the table must show the minimum floors for the kilometer traveled per loaded axle, considering the distances and loads specificities. In addition, the spreadsheet used to obtain the minimum floors must be observed. These values will be readjusted whenever there is a negative variation or greater than 10% in the average diesel consumer price.

According to the Law, whoever hires the service below the minimum floor is subject to fines of twice the difference between the amount paid and the floor owed. The minimum amount owed is R$ 550 and a maximum of R$ 10,500. Those who offer to contract road load transportation below the minimum floor may be fined R$ 4,975.

The law was created to meet truck drivers’ demands for better working conditions. The minimum freight floor was one of the main guidelines for the category, along with rest stops, road conditions, diesel prices, transportation contracts, among others.

Truckers who feel affected or pressured to not comply with the federal law can make complaints through the ANTT communication channels.

Learn about the new rules on the minimum freight value

Since January 2020, the resolution that updates the table with the minimum freight value floor for the cargo transportation by road came into force. Among the changes introduced is the inclusion in the floor calculation the days worked by the trucker.

According to the new rules, the trucker’s profit margin and toll costs do not enter into the minimum floor calculation. Expenditures on logistics movements complementary to load transportation through containers and private or associated fleets are also excluded.

In addition, administration costs, taxes and fees are not included in the calculation. These items will be negotiated between truckers and carriers to make up the final freight value.

According to the “Agência Nacional de Transporte Terrestres” (ANTT), the new resolution also provides for the return freight payment for operations prohibited of bringing cargo back. For example, in the case of a truck that transports fuel and cannot return with another type of load.

Know how to calculate

The freight calculation can be very useful, since it allows estimating costs and finding more economical and efficient means of transporting goods. Further, it helps to avoid possible failures and problems.

The “Agência Nacional de Transportes Terrestres” (ANTT) recommends using the following step by step to calculate the minimum freight to be carried out. On the Agency’s website, you can also find examples of how this calculation is done.

  1. First define the cargo type to be transported, according to the options presented in Annex II of ANTT Resolution No. 5,867/2020.
  2. Next, identify the axles number of the vehicle composition that will be used for transportation.
  3. Next, identify the travel cost (CCD) and load and unload (CC) coefficients for the number of axles loaded from the vehicle composition that will be used.

In this case, if the carrier is hired to use its own motor vehicle and road implement, Table A of Annex II of ANTT Resolution No. 5,867/2020 is used.

If the carrier is going to use its own motor vehicle, and the road implement is provided by the contractor, Table B of Annex II of ANTT Resolution No. 5.867/2020 is used.

If the carrier is hired to use his own vehicle and road implement, Table C of Annex II of ANTT Resolution No. 5,867/2020 is used.

But if the carrier is hired to use his own vehicle and it is a high-performance operation, Table D of Annex II of ANTT Resolution No. 5.867/2020 is used. In this case, the contractor will provide the road implement.

  1. Subsequently, verify the distance to travel in the contracted transport operation.
  2. Finally, use the values obtained in the previous steps in the following formula to calculate the Minimum Freight Floor in Reais per trip (R$/trip):

Minimum freight floor (R$/trip) = (distance x CCD) + CC.

Know how to calculate the freight value online

Many people do not know it, but currently there are tools to calculate shipping online with great practicality. In this way, the trucker can be aware about the expenses involved in transportation and the expenses per vehicle.

As we have seen, the minimum freight value arrived to satisfy the truckers’ demands for better working conditions, consequently it must always be respected.
